AstraZeneca has agreed to pay $1.7bn (£2.7bn) in civil settlement after it paid $5.5bn for counterfeit medicines and health products on top of the $4.5bn it had already been reimbursing for the company.
AstraZeneca’s US patent on Zithromax, a prescription anti-malaria drug, was challenged on grounds that it was “inherently dangerous” and that the patent “has no merit” in light of US Food and Drug Administration regulations.
The company said it had “agreed with the FDA and the regulatory agencies to accept AstraZeneca’s position that its counterfeit products are inadvisable and should not be compensated in any manner”, despite evidence that the drugs were manufactured in high-tech laboratories.
In a statement AstraZeneca said “we take an unwavering position that the product liability claims of AstraZeneca are justified” and that “this product liability action is not appropriate for the company’s other financial obligations”.
AstraZeneca said the “patent issue is settled and resolves the dispute”, adding that it was “not contemplating” the civil settlement.
AstraZeneca’s agreement was subject to negotiations, and the company’s US and European patent on Zithromax was challenged on grounds that the patent was “inherently dangerous” and “breach of contract” and “could not be enforced in any court”.
AstraZeneca’s shares fell 1 per cent to £23.06, or 4.1 per cent, to £23.09, in the fourth quarter of 2019.
